An international business man and a former Chairman of Philips Electronics East Africa has complained of harassment and denial of his conjugal rights by his enstrangled wife.
The business man Tobia Cohen has written to Director of Public Prosecutions(DPP)Noordin Haji and Inspector General of Police Hillary Mutyambai against his wife Sarah Wairimu Kamotho.
“Unless your offices act speedily and accordingly, our client will continue to suffer humiliation, discrimination and persecution because he is not a Kenyan national, which is wrong, distasteful and unfortunate,”said his lawyer Danson Omari.
Cohen a 69 year old Dutch National who has lived in Kenya since 1987 claims Wairimu is determined to abuse the criminal justice by colluding with officers from Parklands Police Station to prosecute him over assault allegations.
“My client is astonished at the manner in which the law is being applied to his disadvantage since no step has been taken by police officer at Parklands Police Station to prosecute Wairimu despite enough evidence demonstrating her guilt, “said Omari.
“On February 5,2019 Sarah Wairimu Kamotho stormed in our client’s home office ,and threw a glass of water aimed at the face of our client and screamed that,do not think this is all,this is not overDO NOT THINK THIS IS ALL.THIS IS NOT OVER.’,”said Omari.
On February 8, 2019 Cohen buried the hatchet and decided to let bygones be bygones after Wairimu approached him and offered him some whisky.
“Around midnight, as he was standing on top of the stairs leading to the garden, Sarah suddenly pushed him down stairs, causing our client to fall and seriously injure his forehead, “Said Omari.
It is said that while he was lying helplessly on the floor bleeding profusely, Wairimu pounced on him and pushed his head against the ground and kicked his helpless temple.
Omari said that on February on 10, 2019 when he regained strength, Cohen went to MP Shah Hospital and was thoroughly checked and a report compiled.
“On February 13,2019 upon the advice of his then counsel, our client made a report to the Parklands Police Station and obtained a P3 form, which was painstakingly filled by the police doctor, “said Omari.
The devastated man said that there has been curious excitement to have him prosecuted for allegedly assaulting Wairimu despite insuffiency of evidence, which intended prosecution he says is aimed not only to soil his reputation but also having him deported from Kenya so that his properties are left with Wairimu.
The man says that sometimes in May 30,2007 he walked Wairimu to his Palacio home and hoped to live with her forever.
After a while they started having misunderstanding allegedly occasioned by Wairimu who was his onetime personal assistant demanding 50 percent stake in his property situated at Farasi Lane
Lawyer Omari in the documents has stated that the two experienced deep misunderstanding due to ownership of the said property to an extent that Wairimu denied his client conjugal rights.
He added that Wairimu has even taught her daughter to be disrespectful to Cohen whether in public or within the family set up.
“The disrespect has since been exacerbated by defamatory statements levied against Cohen with accusations being peddled by Wairimu that he has previously sought sex from their daughter’s male and female friends,”said Omari.
He claims that the aforementioned accusations and degrading treatment has been a deliberate attack on Cohen in the hope of provoking him to a fight, soiling his hard earned reputation as an international businessman, setting him up against criminal charges of defilement and ultimately, by whatever means necessary, securing the ownership of the land at Farasi Lane, LR 2951/449 measuring 0.3162 hectares in her name.
“Despite the incentive to have our client provoked, he has all along been calm and harmless due to his commitment to the laws of Kenya, and his pride as a Dutch patriot that respects women and international relationships, “said Omari.
